MS has an agreement with Apple on licensing quite a few technologies and patents. So, I don’t think Apple won’t sue them.

Apple can’t sue Nokia over this, as its buil in WP8. THey could however sue Microsoft, but that is unlikely… if Nokia had a skin like touchwiz on top of WP8, that had this feature, that was built in to the skin and not used the code of WP8, that would be a different story.

To be fair, this is apple we are talking about, they will probably sue Nokia and Samsung together… Jeez, Apple are probably going to sue every single phone company till it’s the last one standing.
